What Is a Leave and License Agreement?

If you're renting in Mumbai, Pune, or elsewhere in Maharashtra, you'll almost certainly sign a "Leave and License Agreement" rather than a standard rent agreement — and the distinction matters more than it sounds.

What "leave and license" actually means

Under the Indian Easements Act, 1882, a "licence" gives the licensee (the occupant) permission to use a property without transferring any legal interest in it. This is fundamentally different from a "lease," which does create an interest in the property in favour of the tenant. In simple terms: a licence lets you use the space, a lease gives you a stake in it.

Why Maharashtra structures rentals this way

Historically, tenancy laws in Maharashtra (starting with the Bombay Rents, Hotel and Lodging House Rates Control Act, and continuing under the Maharashtra Rent Control Act, 1999) offered strong protections to tenants under a traditional lease or tenancy, making it genuinely difficult for landlords to reclaim possession once let out. By structuring the arrangement as a "leave and license" instead, landlords avoid creating a tenancy relationship in the first place, which keeps the process of regaining possession at the end of the term far more straightforward.

Licensor and licensee, not landlord and tenant

You'll notice the agreement itself uses different terminology — "licensor" for the property owner and "licensee" for the occupant, instead of "landlord" and "tenant." This isn't just a style choice; it reflects and reinforces the underlying legal relationship being created.

Registration is mandatory, regardless of term

Unlike some other states where short-term agreements can skip formal registration, Maharashtra requires every Leave & License agreement to be registered, no matter how short the duration. Stamp duty is generally calculated at around 0.25% of the total consideration (rent for the full term plus a notional value on the deposit), and the process typically includes biometric verification of both parties through the state's online registration system.

What this means if you're the licensee

Even though a licence doesn't give you formal "tenancy rights," you're still fully entitled to occupy the property for the agreed term and to the return of your security deposit as specified in the agreement. It remains a legally binding, enforceable document — it's simply structured differently so that eviction and renewal stay simple for the property owner.
